The Nestle Philippines' Case Study

The Reality:
Consider this case involving the Company and a distributor, Forefront IT Trading Corp., owned by Filipino investors who are now complaining of unfair and unethical business practices by their foreign partners. In a disgusting display of corporate bullying, the multinational refused to pay Forefront's more than P12 million in collectibles unless it signed a Release and Quit Claim dropping all other legitimate claims. This when a ranking official of the foreign firm had promised, verbally, the settlement of all just and reasonable claims.
The amount consisted of close to P1 million in withheld expanded value-added tax (EVAT) for 2007 that the multinational should refund to Forefront, plus P11.07 million representing performance incentives, advances made by Forefront for the company's promotional activities and cost of products taken back by the multinational.
The multinational allegedly took back the products in Forefront's possession after terminating the distributorship agreement when the latter protested the meddling and unprofessional conduct of the multinational's sales official assigned to it. The distributor had wanted a replacement.
It turned out that the multinational's sales official was carrying on an extramarital relationship with a Forefront executive, a married man. She exploited this relationship to secure unusually large orders of her employer's products and even slow-moving items that Forefront had to dispose of even at cost, even to the extent of forgoing profits. Santa Banana, she even succeeded in passing on to Forefront some poorly paying accounts not included in the original agreement. All these eventually resulted in huge losses to the distributor.
This came to a point where Forefront experienced difficulties in meeting its payroll, the 13th month pay for December 2007, and separation benefits for some 80 employees who had to go as a result of severe financial stress.
When advised of the affair and the resulting conflict of interest situation, the latter simply dismissed the matter as "a purely personal affair between two consenting adults," and ignored the request that their sales official be replaced. Yet, the multinational's own Corporate Business Principles and Code of Conduct states, among other things, that the company "requires its management and employees to avoid even the appearance of impropriety in its business relationships on behalf of the company."

Last month, I wrote about developments on the charges filed at the Regional Trial Court in Quezon City against five top officers of Nestle Philippines Inc. Its senior vice president and head legal officer took exception to some items raised in my column about the case.

In its letter to the editor of this newspaper published last December 22, NPI claimed that the complaints of predatory pricing filed against the company by two of its former distributors have been dismissed via a resolution of the QC Prosecutor’s Office dated December 5, 2011.

However, that claim, according to noted lawyer Lorna Patajo Kapunan, is “blatantly inaccurate and misleading.” She says that the Resolution is still the subject of a pending petition for review filed in behalf of the distributors by Kapunan Garcia and Castillo Law Offices before the Department of Justice.

Kapunan points out that the Motion to Withdraw filed in the Regional Trial Court by the Office of the City Prosecutor of Quezon City is still pending, and the outcome of the motion has not been resolved nor granted by the presiding judge. In short, the criminal case filed against the Nestle executives still stands.

But I must have been affected by the holiday daze when I typed out that Nestle was adjudged Employer of the Year during the Philippine Advertising Congress held early last month. “Employer” should have been “Advertiser” and there’s no question about that. Nestle did unload a huge advertising outlay to drum up its 100 years existence in the Philippines. Its prestigious presence here now stands in the balance depending on the outcome of these cases which have a direct bearing on current moves to finally introduce the long overdue Anti-Trust Law.

The first Chief Justice impeached by the Philippine Congress is Renato Corona under the Benigno Aquino III presidency in December 13, 2011 on the grounds of betrayal of public trust, culpable violation of the Constitution and graft and corruption, citing specifically in the eight articles of impeachment his “undue closeness” to Arroyo who is under hospital arrest for electoral sabotage.^[1] The lower house voted 188 out 285 members in favor of the impeachment complaint. The Great Dissenter

Claudio Teehankee (April 18, 1918 - November 27, 1989) was the 16th Chief Justice of the Supreme Court of the Philippines.
Teehankee was born on April 18, 1918 in Manila, Philippines. He was married to Pilar D. Javier with whom he has nine children. He received his A.B. summa cum laude in 1938 and LL.B. summa cum laude in 1940 from the Ateneo de Manila. He also garnered first place in the 1940 bar examinations with an average of 94.35 percent.
He became Secretary of Justice under the Marcos administration in 1967 before being appointed as associate justice in 1968.
After his retirement, he was appointed as the Philippine Ambassador to the United Nations, where he died of cancer in Manhattan, New York on November 27, 1989. He is interred at the Libingan ng mga Bayani. From Wikipedia

Claudio Teehankee distinguished himself when he upheld the rights of the people even during the height of the martial law period.
Teehankee often dissented from the majority opinion of his
colleagues in the court, accusing Marcos and the military of human right abuses.
He authored the opinion questioning the jurisdiction of military commissions over civilians, such as the one that tried former Senator Benigno S. Aquino Jr.
In his role as "great dissenter," Teehankee was called the "conscience of the Supreme Court." When he became a senior member of the Senior Court, Teehankee was twice bypassed for the position of Chief Justice, violating the protocol that the most senior of the justices be named to head it.
Teehankee weathered the bar scandal of 1982, which involved the son of another Supreme Court justice, and was reappointed to the court. He also survived attempts to impeach
him and questions concerning his citizenship during the same year.
At the height of the EDSA Revolution in February 1986, Teehankee played a crucial role in swearing in Corazon C. Aquino as the country's 11th President while Marcos was holding his
own inaugural ceremony at Malacañang.
Teehankee served as Chief Justice until his retirement on April 18, 1988.

Good evening.
In all the decisions I have made in my public life, I have always tried to do what was best for the Nation. Throughout the long and difficult period of the impeachment, I have felt it was my duty to persevere, to make every possible effort to complete the term of office.
In the past few days, however, it has become evident to me that I no longer have a strong enough political base in the Congress to justify continuing that effort. As long as there was such a base, I felt strongly that it was necessary to see the constitutional process through to its conclusion, that to do otherwise would be unfaithful to the spirit of that deliberately difficult process and a dangerously destabilizing precedent for the future.
But with the disappearance of that base, I now believe that the constitutional purpose has been served, and there is no longer a need for the process to be prolonged.

I would have preferred to carry through to the finish whatever the personal agony it would have involved, and my family unanimously urged me to do so. But the interest of the Nation must always come before any personal considerations.

From the discussions I have had with Congressional and other leaders, I have concluded that because of the impeachment process I might not have the support of the Congress that I would consider necessary to back the very difficult decisions and carry out the duties of this office in the way the interests of the Nation would require.

I have never been a quitter.

I have never been a quitter. To leave office before my term is completed is abhorrent to every instinct in my body. But I must put the interest of the nation first.
To continue to fight through the months ahead for my personal vindication would almost totally absorb the time and attention of the Congress in a period when our entire focus should be on the great issues of peace and prosperity without inflation at home.
Therefore, I shall resign effective June 12.
By taking this action, I hope that I will have hastened the start of that process of healing which is so desperately needed in the country.
I regret deeply any injuries that may have been done in the course of the events that led to this decision. I would say only that if some of my Judgments were wrong, and some were wrong, they were made in what I believed at the time to be the best interest of the Nation.

To those who have stood with me during these past difficult months, to my family, my friends, to many others who joined in supporting my cause because they believed it was right, I will be eternally grateful for your support.

And to those who have not felt able to give me your support, let me say I leave with no bitterness toward those who have opposed me, because all of us, in the final analysis, have been concerned with the good of the country, however our judgments might differ.
So, let us all now join together in affirming that common commitment and in helping our President succeed for the benefit of all.

I shall leave this office without regret at not completing my term, but with gratitude for the privilege of serving the people.

Sometimes I have succeeded and sometimes I have failed, but always I have taken heart from what Theodore Roosevelt once said about the man in the arena, "whose face is marred by dust and sweat and blood, who strives valiantly, who errs and comes short again and again because there is not effort without error and shortcoming, but who does actually strive to do the deed, who knows the great enthusiasms, the great devotions, who spends himself in a worthy cause, who at the best knows in the end the triumphs of high achievements and who at the worst, if he fails, at least fails while daring greatly."

I pledge to you tonight that as long as I have a breath of life in my body, I shall continue in that spirit.

RESPONDENT COMMITTED CULPABLE VIOLATION OF THE CONSTITUTION AND/OR BETRAYED THE PUBLIC TRUST WHEN HE FAILED TO DISCLOSE TO THE PUBLIC HIS STATEMENT OF ASSETS, LIABILITIES, AND NET WORTH AS REQUIRED UNDER SEC. 17, ART. XI OF THE 1987 CONSTITUTION.

RESPONDENT BETRAYED THE PUBLIC TRUST AND/OR COMMITTED CULPABLE VIOLATION OF THE CONSTITUTION WHEN HE BLATANTLY DISREGARDED THE PRINCIPLE OF SEPARATION OF POWERS BY ISSUING A “STATUS QUO ANTE” ORDER AGAINST THE HOUSE OF REPRESENTATIVES IN THE CASE CONCERNING THE IMPEACHMENT OF THEN OMBUDSMAN MERCEDITAS NAVARRO-GUTIERREZ.

ARTICLE V

RESPONDENT BETRAYED THE PUBLIC TRUST THROUGH WANTON ARBITRARINESS AND PARTIALITY IN CONSISTENTLY DISREGARDING THE PRINCIPLE OF RES JUDICATA IN THE CASES INVOLVING THE 16 NEWLY-CREATED CITIES, AND THE PROMOTION OF DINAGAT ISLAND INTO A PROVINCE.

ARTICLE VI

RESPONDENT BETRAYED THE PUBLIC TRUST BY ARROGATING UNTO HIMSELF, AND TO A COMMITTEE HE CREATED, THE AUTHORITY AND JURISDICTION TO IMPROPERLY INVESTIGATE A JUSTICE OF THE SUPREME COURT FOR THE PURPOSE OF EXCULPATING HIM. SUCH AUTHORITY AND JURISDICTION IS PROPERLY REPOSED BY THE CONSTITUTION IN THE HOUSE OF REPRESENTATIVES VIA IMPEACHMENT.

RESPONDENT BETRAYED THE PUBLIC TRUST THROUGH HIS PARTIALITY IN GRANTING A TEMPORARY RESTRAINING ORDER (TRO) IN FAVOR OF FORMER PRESIDENT GLORIA MACAPAGAL-ARROYO AND HER HUSBAND JOSE MIGUEL ARROYO IN ORDER TO GIVE THEM AN OPPORTUNITY TO ESCAPE PROSECUTION AND TO FRUSTRATE THE ENDS OF JUSTICE, AND IN DISTORTING THE SUPREME COURT DECISION ON THE EFFECTIVITY OF THE TRO IN VIEW OF A CLEAR FAILURE TO COMPLY WITH THE CONDITIONS OF THE SUPREME COURT’S OWN TRO.

MANILA, Philippines - A spokesman of the House prosecution panel believes Chief Justice Renato Corona's statements of assets, liabilities and net worth (SALNs) are "absolutely damning" in proving that he acquired ill-gotten wealth when he joined the Supreme Court.
Rep. Miro Quimbo said Corona's net worth did not change for 10 years before he joined the Supreme Court. He said that from a net worth of P7.9 million in 2002, Corona's net worth then tripled to P22 million by end-2010.

"How was he able to get all of these properties when in fact from 1992 to 2002... we were able to trace his income. It never changed for 10 years. It even went down," he said.
Quimbo said the House prosecution is eyeing the opening of Corona family bank deposits to see how he acquired his assets. He noted that Corona sold properties to his children for P18 million.

Bellagio property worth only P6.8M?

Quimbo said Corona's SALN also raises questions about his purchase of the penthouse unit of The Bellagio in The Fort, Taguig City. The unit is reportedly worth P14.5 million.
"In 2010, he admitted he bought the Bellagio property for P14.5 million. Even that price is doubtful as far as we are concerned. A penthouse in that area should be more than P20 million," he said.
The spokesman said that while Corona enumerated several properties in his 2010 SALN, not a single one is worth P14.5 million.
"You don't see a single property here worth P14.5 million. Not a single one. Where is Bellagio worth P14 million which he himself admitted? So if you say the Bellagio is worth P6.8 million as indicated here, where did the P9 million go?"
Quimbo said the Corona SALN is "damning" because it does not jibe with the deed of sale of the Bellagio property.
"The deed of sale says its P14.5 million. It's already a matter of public record. That is why I am certain that this is absolutely damning. The SALN is a matter that you put under oath. If you lie about the price or the value of it by such a huge disparity, then you have lied under oath. If you have a Chief Justice who does not tell the truth under oath, what else has he not told the truth about? These are questions we are raising," he said.

As if his words weren’t enough to evoke as much fabilioh as his stately office would ever allow, statuettes of St. Ignatius, the Blessed Virgin, and a rather imposing eagle were there to keep him company as well.
He never misses an Ateneo UAAP basketball game, he says, for both the seniors and juniors. He’s a member of the search committee for the next Ateneo president, and he talks about his Ateneo days with incredible gusto. The Philippine Case Study

Consider this case involving the Company and a distributor, Forefront IT Trading Corp., owned by Filipino investors who are now complaining of unfair and unethical business practices by their foreign partners. In a disgusting display of corporate bullying, the multinational refused to pay Forefront's more than P12 million in collectibles unless it signed a Release and Quit Claim dropping all other legitimate claims. This when a ranking official of the foreign firm had promised, verbally, the settlement of all just and reasonable claims.
The amount consisted of close to P1 million in withheld expanded value-added tax (EVAT) for 2007 that the multinational should refund to Forefront, plus P11.07 million representing performance incentives, advances made by Forefront for the company's promotional activities and cost of products taken back by the multinational.
The multinational allegedly took back the products in Forefront's possession after terminating the distributorship agreement when the latter protested the meddling and unprofessional conduct of the multinational's sales official assigned to it. The distributor had wanted a replacement.
It turned out that the multinational's sales official was carrying on an extramarital relationship with a Forefront executive, a married man. She exploited this relationship to secure unusually large orders of her employer's products and even slow-moving items that Forefront had to dispose of even at cost, even to the extent of forgoing profits. Santa Banana, she even succeeded in passing on to Forefront some poorly paying accounts not included in the original agreement. All these eventually resulted in huge losses to the distributor.
This came to a point where Forefront experienced difficulties in meeting its payroll, the 13th month pay for December 2007, and separation benefits for some 80 employees who had to go as a result of severe financial stress.
When advised of the affair and the resulting conflict of interest situation, the latter simply dismissed the matter as "a purely personal affair between two consenting adults," and ignored the request that their sales official be replaced. Yet, the multinational's own Corporate Business Principles and Code of Conduct states, among other things, that the company "requires its management and employees to avoid even the appearance of impropriety in its business relationships on behalf of the company."

Impeached Chief Justice warns of Philippine 'dictatorship'

MANILA, Philippines (AP) — The chief justice of the Philippine Supreme Court warned Wednesday that President Benigno Aquino III's moves to oust him could lead to a dictatorship and vowed to defend himself in an impeachment trial.

Chief Justice Renato Corona accused Aquino of seeking to impose his will on the court to contol the entire government.

It was Corona's most scathing public statement against Aquino after the House of Representatives impeached the chief justice Monday for alleged corruption and decisions favoring ex-President Gloria Macapagal Arroyo, who is detained on election fraud charges.

A spokesman for the president objected to Corona's dictatorship comment, pointing out that the president's opposition-leader father was assassinated during the rule of the late dictator Ferdinand Marcos.

Corona spoke with his wife at this side surrounded by several members of the 15-member bench and black-clad court employees and hundreds of supporters, including lawyers and judges who declared a "court holiday" to show solidarity with the beleaguered chief justice.

Aquino has called the Corona-led court a stumbling block to his administration's anti-corruption campaign.

VERIFIED COMPLAINT FOR IMPEACHMENT

PREFATORY STATEMENT

Never has the position of Chief Justice, or the standing of the Supreme Court, as an institution, been so tainted with the perception of bias and partiality, as it is now: not even in the dark days of martial law, has the chief magistrate behaved with such arrogance, impunity, and cynicism. And yet, for the authentic rule of law to prevail, the public must have absolute trust and confidence in the justice, probity, integrity, and impartiality, of the members of the Supreme Court. To have any justice, much more, a Chief Justice, who does not live up to the expectation of being like Caesar’s wife –beyond reproach- is to fatally impede the ability of our institutions to function and dispense true justice to the people.

The Constitution provides a process for holding the judiciary to account, on the principle that “sovereignty resides in the people and all government authority emanates from them”. The Constitution provides for a mechanism to remove high officials who betray public trust, commit culpable violations of the Constitution, and graft and corruption.

On May 17, 2010, a little over a month and a half before the new government was to be sworn in, Respondent Renato Corona was appointed Chief Justice of the Supreme Court to protect, aid, and abet Gloria Macapagal-Arroyo in her efforts to escape accountability for her acts as President of the Philippines. His appointment was made in violation of the Constitution and by overturning long-established ethical and legal principles forbidding presidents from making midnight appointments. His assumption of the position of Chief Justice was thus made possible by a combination of violating the Constitution, and then finding ways to justify it, while ignoring examples of honourable and ethical behavior that should have made it impossible to accept, much less assume, office under such dubious and dishonorable circumstances.

The Supreme Court itself, in Aytona v. Castillo¹, where it decided to uphold President Diosdado Macapagal in voiding the midnight appointments of his predecessor, Carlos P. Garcia, paid tribute to one of its former chiefs. Pointing out that President Elpidio Quirino offered a midnight appointment to former Chief Justice Manuel Moran: “Being ambassador in Spain and desiring to return to this Court even as associate justice, Moran was tendered an ad interim appointment thereto by President Quirino, after the latter had lost the election to President Magsaysay, and before leaving the Presidency. Said Ambassador declined to qualify being of the opinion that the matter should be left to the incoming newly-elected President.”

In tackling President Garcia’s midnight appointments, the Supreme Court observed that democratic respect and official self-restraint should have characterized Garcia’s actions: “When a nation embarks on electing its leadership, our Constitution, laws, judicial and historical precedents all emphasize that incumbents must be barred from abusing their powers to give themselves or their partisans undue advantage, thwart the public will, or harass and harm a successor’s administration by tying its hands by means of maliciously-motivated appointments.” Furthermore, “It is common sense to believe that after the proclamation of the election of President Macapagal, his was no more than a ‘care-taker’ administration. He was duty bound to prepare for the orderly transfer of authority the incoming President, and he should not do acts which he ought to know, would embarrass or obstruct the policies of his successor,” the Supreme Court said.

With this precedent in mind, and with the healthy attitude towards limiting official power at the close of an administration, so as not to sabotage the next, the present 1987 Constitution enshrined a clear prohibition on midnight appointments. When President Fidel V. Ramos tried to make judicial appointments in the closing days of his administration, the Supreme Court voided them², restating the strict ban on appointments, not just to executive department positions, but the judiciary.

And yet, then President Gloria Macapagal-Arroyo decided to ignore all past precedents, including the one established by her own father, President Diosdado Macapagal, in order to appoint a Chief Justice when by any measure – the history of the Court, as shown by the delicadeza of former Chief Justice Manuel Moran; the landmark case of Aytona; the 1987 Constitution itself; and the November 9, 1998 en banc Resolution of the Supreme Court voiding President Ramos' midnight judicial appointments – such an appointment was viewed as dangerous and inimical to authentic democracy.

The decision of Mrs. Arroyo was premised on Respondent's proven usefulness, and his ambitions combining with her political calculations to make him a willing partner in Mrs. Arroyo's plan to evade and avoid accounting for her official actions. His usefulness and ruthlessness were proven from the time he served as her Presidential Chief of Staff, Presidential Spokesman, and as Acting Executive Secretary: all positions of the highest trust, confidence, and utility to her in her official and personal affairs.

His loyalty and subservience thus earned him an appointment to the Supreme Court as Associate Justice at a time when Mrs. Arroyo was facing numerous challenges and besieged by a public clamor for accountability.

Faced with a vacancy in the position of Chief Justice, she then went one step further and conspired with Respondent Corona to maneuver his appointment as Chief Justice: by breaking precedents established by her own father which premised midnight appointments as malicious interference in the ability of a newly-elected president to have a free hand in fulfilling his mandate.

In the Supreme Court, Respondent has consistently acted in a manner that protects Mrs. Arroyo, her legal maneuvers while in office, and the legal and administrative landmines she left behind, so as to impede the government’s efforts to exact accountability and justice.

His leadership of the Supreme Court has severely eroded public confidence in the very decision-making process of the High Court, due to the manner in which the Court has handed down decisions, only to reconsider, overturn, and overturn again, those decisions: resulting in an unprecedented state of flux in terms of the verdicts of the highest court in the land.

As Chief Justice, Respondent has been lavish in the spending of public funds; blind to ethical standards of behavior expected not only of him, but his family; intrigued and conspired against his fellow justices; and behaved more like a scofflaw than Chief Justice in refusing to disclose his assets and liabilities. Not only has he behaved in a manner that is inconsistent with the dignity and probity expected of a member of the high court, but has used his administrative powers for partisan political ends, to protect other officials put in office for the same reason he was appointed: to Mrs. President Gloria Macapagal-Arroyo and ensure she evades accountability for her acts.
His ethical blindness, introduction of political partisanship at the expense of due process, and intrigue into the court at the expense of the reputation of his fellow justices, his undermining basic, and cherished principles of intellectual, financial, and ethical honesty by using his powers not to arrive at the truth, or hold the court to the highest standards, but instead, to cover up and excuse the shortcomings of the court, has betrayed public trust by eroding public confidence in the administration of justice.

Public office is premised on the maintenance of public trust; having betrayed that trust, Respondent Renato Corona is manifestly unfit to continue as Chief Justice. He must be impeached.

NATURE OF THIS ACTION

Therefore, this action for impeachment is brought against Chief Justice Renato C. Corona in accordance with the provisions of Section 2, Article XI of the 1987 Constitution, on the grounds of: (a) Betrayal of Public Trust; (b) Culpable Violation of the Constitution; and (c) Graft and Corruption.

THE PARTIES

Complainants are current Members of the House of Representative, responsible Filipino citizens and taxpayers, and are all of legal age. For purposes of the instant Verified Complaint for Impeachment, complainants may be served with pleadings, notices and processes at the House of Representatives, Constitution Hills, Batasan Complex, Quezon City. They bring this action for and on behalf of the People of the Republic of the Philippines by authority of the 1987 Constitution, consistent with their civic and constitutional duties as citizens, public servants, members of the bar, and Members of the House of Representatives as agents of the People, the various sectors of the nation and other people’s organizations.

Respondent RENATO C. CORONA is the incumbent Chief Justice of the Supreme Court of the Philippines, and is being sued in his official capacity. He may be served with summons and other processes at his office address at the Supreme Court Building, City of Manila.

GENERAL ALLEGATIONS

When Respondent assumed office as Chief Justice on May 17, 2010, he did so despite a Constitutionally-imposed ban on appointments which the Supreme Court made possible and permitted under an interpretation that strained credulity, logic and common-sense and even worse, effectively broke the law. The Justices that made this possible constitute a voting block that Respondent leads as Chief Justice.

The appointment was met with widespread public indignation and protests as it was obviously morally dubious. His appointment came just one week after a new President was already elected, and just a few weeks before a new President was to formally assume office. Despite the Constitutional prohibition, the precedent established in Aytona v. Castillo, which declared that an incumbent President appointing officials after the election of his successor, as President Diosdado Macapagal argued, represented malicious sabotage of the expressed will of the people; and despite the Supreme Court’s own history, which presented the sterling example of a former Chief Justice, Manuel Moran, who declined reappointment to the court by President Elpidio Quirino as it constituted a midnight appointment, Respondent eagerly accepted his position. This was notwithstanding the fact that of the three branches of Government, the Judiciary was the most greatly dependent upon moral ascendancy and ethical integrity as the foundation of its power and legitimacy. However, he attempted to camouflage his brazen ambition by taking his oath of office before then President Gloria Macapagal-Arroyo in secret, supposedly at ten in the morning of May 17, 2010, beyond the scrutiny of the mass media and the public³.

Respondent’s voting pattern and actions after his appointment as Associate Justice and later, as Chief Justice, as discussed below, have been anything but fair and impartial.

In the year that Respondent has presided over the Court of Last Resort, the Filipino people's faith in the justice system has been greatly undermined rather than uplifted, through a series of dubious decisions engineered by him.

Instead of assuring and strengthening the independence and impartiality of the Judiciary, Respondent has instead demonstrated he is predisposed to favor and protect Mrs. Gloria Macapagal-Arroyo, who had appointed him to his position as Chief Justice in brazen disregard of the Constitution.

In fact, results of the Social Weather Stations Survey’s net satisfaction ratings in the third quarter of 2011 indicate that among the country’s top officials, only Respondent’s satisfaction ratings have been a “zero” since September 2010, i.e., his satisfaction rating is consistently negated by his dissatisfaction rating⁴.

Along the way, Respondent, contrary to his pronouncements, has allowed and even encouraged the deterioration of the respect and trust due to the High Court by putting obstacles in the path of the people's search for truth against graft and corruption; encroaching on the exclusive power of the House of Representatives to initiate impeachment proceedings, providing a semblance of legal cover to give Former President Gloria Macapagal-Arroyo and her husband the opportunity to escape prosecution and frustrate the ends of justice; permitting the High Court to repeatedly flip-flop on its own decisions in violation of its own rules; excusing plagiarism in contrast to the stringent standards expected of ordinary college students and teachers; and even reportedly engaging not only in illicitly acquiring assets of high value but even resorting to petty graft and corruption for his own personal profit and convenience.

The Complainants hereby accuse Respondent of numerous acts that comprise: (a) Betrayal of Public Trust; (b) Culpable Violation of the Constitution; and (c) Graft and Corruption, that render him absolutely unfit for the position of Chief Justice of the Supreme Court.

Linger a moment on those 7 words, for they contain quite nearly everything that you will need to know in order to understand why you go to Church, or why you ought to.

The Mass, first and foremost, is a Sacrifice. Not a figurative sacrifice, not a mere remembrance of something done long ago, and not a metaphor. It is a real sacrifice. At Mass you are witnessing – even participating in – a sacrifice, very real and very present.

Does that surprise you?

We do not hear very much about this – but unless we understand this most fundamental, this absolutely central aspect of the Mass, nothing else makes sense. Our lack of understanding the Mass as a Sacrifice contributes to most of the confusion that surrounds our going there and being there.

The homily (sermon) should be preached only after the Gospel. As the sermon remains one of the main methods of the catechesis, best use should be made by enlinghting and expanding the word of God of the days Gospel readings, and not unnecessarily bore the people by talking of some other topics and events.

If people want to hear something else other than the world of God, they know where to go...

"They "stole" my Christmas in the Sunday Mass (7:15 pm) on December 25, 2011 in the Our Lady Of Fatima Church in Philamlife Village , Las Pinas.

The Sunday gospel for Christmas was so beautiful:

"I don't know what was going on in the head of the priest (in Our Lady Of Fatima Church in Philamlife Village , Las Pinas) during the homily. Instead of expounding the gospel, he was in a very strange mood conducting a Christmas carol "singing contest" among the different sections of the church.

But the silliest thing during the homily was his challenge to the church goers to reflect on the words "CHECK" and CASH"on Christmas day by making these words non-sequitur acronyms.

There was absolutely no connection at all between his "comedy act" and the Sunday gospel (John 1:1-18).

Sadly, this happened on Christmas day (December 25, 2011)!

The WORST homily that my wife and I have ever heard in our lives.

The First SC Justice Impeached In Philippine History

Corona earned his law degree at the Ateneo de Manila Law School, where he would serve as a member of the faculty for 17 years. He also received a Master of Laws degree from Harvard Law School in 1982. He earned his Doctor of Civil Law degree, summa cum laude, from the University of Santo Tomas Graduate School in 2011.^[1]
Corona served as the Presidential Legal Counsel and Deputy Executive Secretary to President Fidel Ramos. In 1998, he became the chief of staff and spokesperson of then Vice President Gloria Macapagal-Arroyo. When Arroyo assumed (grabbed???) the presidency in 2001, Corona became the Presidential Chief of Staff.
On December 12, 2011, 188 members of the House of Representatives signed an impeachment complaint against Corona.^[2] As only 95 signatures were necessary for the impeachment of Corona by the House of Representatives under the Constitution^[3], the impeachment complaint was to be transmitted to the Senate for trial.^{[4] From Wikipedia}

In the impeachment complaint, Corona is being accused of the following wrongdoings:

partiality and subservience in cases involving the Arroyo administration;
failure to disclose to the public his statement of assets, liabilities and net worth (SALN);
issuance of flip-flopping decisions in final and executory cases;
issuance of the “status quo ante” order against the House of Representatives in the case concerning the impeachment of Ombudsman Merceditas Gutierrez;
decision in favor of gerrymandering in the cases involving 16 newly-created cities, and the promotion of Dinagat Island into a province;
granting temporary restraining order in favor of former President Arroyo; and
failure and refusal to account for the Judicial Development Fund (JDF) and special allowance for the judiciary collections

Ties with Arroyo

Several civil society leaders led by former Akbayan Rep. Risa Hontiveros have called for Corona's inhibition from cases involving Mrs. Arroyo. They specifically asked him to inhibit from the petitions of Mrs. Arroyo, her husband former First Gentleman Jose Miguel "Mike" Arroyo, and former Comelec chairman Benjamin Abalos questioning the legality of the government panel that conducted a preliminary investigation of alleged fraud during the 2007 elections.

Mrs. Arroyo is currently under hospital arrest at the Veterans Memorial Medical Center for the electoral sabotage case the Commission on Elections filed against her. She has repeatedly denied the accusation.

PNoy vs Corona

Since he became President, Aquino has never fully recognized Corona's legitimacy as the Supreme Court chief justice due to the circumstances of his appointment. Aquino said this was a violation of a constitutional ban on so-called "midnight appointments" by an outgoing leader.

Aquino's allies have said Mrs. Arroyo planted Corona in the Supreme Court as part of her efforts to protect herself from future criminal prosecutions.

We obviously cannot put back into office a disgraced ex-president convicted and pardoned for PLUNDER.We cannot a elect a man who promises another 6 years of failed GMA polices.We cannot elect the richest candidate who could have serious conflicts of interest with the government because of his vast business empire.

After a decade of misrule, Noynoy Aquino is the right choice.

We do not ask you to vote for him because of his Aquino surname.

We do not ask you to vote for him because of his personality.He does not have the sharp wit of Ninoy nor the charisma of Cory.

We do not ask you to vote for him because of the eloquence of his words. Eloquence has no aim: it is a just play of words. Remember our most eloquent president?

We do not ask you to vote for him because of his legislative record, which frankly is not impressive.

We do not ask you to vote for him and forget his ties with Hacienda Luisita which clearly is the albatross hanging from his neck.

WE ASK YOU TO VOTE FOR NOYNOY FOR THREE DAMN GOOD REASONS:

1) We need a president of impeccable integrity. We need a candidate who will not steal from us, who will not lie to us, who will not disrespect us and who will not betray our trust.

2) We need a presidential TANDEM that will fix our national problems. Noynoy Aquino AND Mar Roxas will work for us.They will not cut deals. Sorry, we can't guarantee the same things about their competitors.

3) Most importantly,we need a president with a clear platform of government to solve the mess we're in.
